Legal period for the right of withdrawal

In accordance with the legal provisions in force, you have a period of 14 days from receipt of your products to exercise your right of withdrawal without having to provide reasons or pay a penalty. After communicating your decision to exercise your right of withdrawal within this 14-day period, you have another period of 14 days to return the product(s) concerned by the withdrawal.

The right of withdrawal does not apply to customers outside the European Union.

Contractual withdrawal period

At Luminaire Lucciano we offer you the possibility to exercise your right of withdrawal within 14 days from the receipt of the products. You then have another period of 14 days from the communication of your decision to withdraw to return the product(s) concerned to us.

In the event of an order containing several products, placed on luminaire-lucciano.com , the 14-day period to communicate your decision to withdraw starts from the receipt of the last product.

The terms and conditions for exercising your right of withdrawal are specified below.

Conditions for exercising the right of withdrawal

In the event of exercising the right of withdrawal within the period referred to in 24.2, only the price of the product(s) purchased and the shipping costs will be refunded, with the return costs remaining your responsibility.

Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) allowing their resale in new condition, and, if possible, accompanied by a copy of the purchase invoice for optimized management. In the event of depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product, you may be held liable.

To exercise your right of withdrawal, in accordance with legal provisions, you will find below, in the appendix, the standard withdrawal form to send to us at the following address: info@luminaire-lucciano.com . You can exercise your right of withdrawal by any means and in particular by post or email to info@luminaire-lucciano.com expressing your wish to withdraw without any ambiguity, and mentioning the order concerned by this withdrawal.

Once the withdrawal form or declaration has been sent to Luminaire Lucciano no later than 14 days after receipt of your order, you must return the product(s) concerned to the address of Luminaire Lucciano, within a reasonable time and, at the latest, within 14 days from sending the withdrawal form or declaration.

In accordance with Council Regulation No 1182/71/EEC of 3 June 1971 determining the rules applicable to periods, dates and terms:
1° The day on which the contract is concluded or the day of receipt of the goods is not included in the period mentioned in the article L. 221-18 ;
2° The period begins to run at the beginning of the first hour of the first day and ends at the expiration of the last hour of the last day of the period;
3° If this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

When the information relating to the right of withdrawal has not been provided to the consumer under the conditions provided for in 2° of the article L. 221-5, the withdrawal period is extended by twelve months from the expiry of the initial withdrawal period, determined in accordance with Article L. 221-18 .
However, where the provision of such information occurs during such extension, the withdrawal period shall expire at the end of a period of fourteen days from the day on which the consumer received such information.

The burden of proof of the exercise of the right of withdrawal under the conditions provided for in Article L. 221-21 weighs on the consumer.

Refund

In the event of exercising the right of withdrawal, Luminaire Lucciano will reimburse the sums paid (including delivery costs) at the latest within 14 days from the date on which Luminaire Lucciano is informed of your decision to withdraw and using the same means of payment as that used for the order (except your express agreement for a refund using another means of payment). This refund date may be deferred until recovery of the product or until you have provided proof of shipment of the product, the date retained being that of the first of these facts. Luminaire Lucciano is not required to reimburse you for the additional costs if you have expressly chosen a more expensive delivery method than the standard delivery method offered on Luminaire-Lucciano.com

It is however specified, in the event of a total or partial payment by gift vouchers, that these cannot be reimbursed in cash, by check or by credit card. The reimbursement of purchases made by gift vouchers will be made exclusively in the form of gift vouchers for an amount identical to that paid in this form.

No cash on delivery shipments will be accepted for any reason.

In the event of a size exchange, we will reimburse you for the full return costs up to a limit of €5.
